D.A. Office Punts Aldon Smith Case to L.A. City Attorney

The 49ers linebacker Aldon Smith of San Ramon is accused of making a comment about having a bomb at a Los Angeles International Airport security screening station.

Los Angeles County prosecutors have referred the case against San Francisco 49ers linebacker Aldon Smith, who is accused of making a comment about having a bomb at a Los Angeles International Airportsecurity screening station, to the City Attorney's Office for consideration of possible misdemeanor charge.

Frank Mateljan, a spokesman for the City Attorney's Office, said today the case is "under review." He said no decision had been made on whether to file charges.

Smith, 24, was arrested about 2 p.m. April 13 in Terminal 1, and was booked at the Los Angeles Police Department's Pacific Station on suspicion of making a false report of a bomb threat, according to Airport Police Sgt. Karen Ortiz.

Smith was released about 7 p.m. that night on $20,000 bail, according to the Los Angeles County Sheriff's Department.

In a statement, 49ers General Manager Trent Baalke said: "We are disappointed to learn of the incident involving Aldon Smith. As this is a pending legal matter and we are still gathering the pertinent facts, we will have no further comment."

Smith, who lives in San Ramon, was approached by airport police in the gate area after he made the comment, and was arrested when he became uncooperative, Ortiz said.
